The Uber driver who accused Tampa Bay Buccaneers starting quarterback Jameis Winston of sexual assault has filed a lawsuit seeking damages in excess of $75,000.
On Tuesday, the driver who identified herself under the pseudonym “Kate P.” filed a lawsuit against Winston in a U.S. District Court for the District of Arizona.
Kate is requesting exemplary or punitive damages in excess of $75,000 because of the “damages in the nature of emotional distress and future therapy expenses.”

Early in the morning on March 13, 2016, according to the lawsuit, Kate received and accepted a request for a ride from a “Jameis W” at the International Club in Scottsdale, Ariz., with a destination of the Camby Hotel in Phoenix, Ariz. After picking up Winston and driving a few blocks from the club he requested that the driver stop somewhere to get a “burrito.” Kate then preceded to drive Winston to a fast food Mexican restaurant called Los Betos where Mr. Winston could order some food through the drive-through window. While waiting for the food to arrive and without any warning, Kate alleges that Winston leaned toward her and placed his fingers between her legs and pressed them firmly against her vagina over her yoga pants. She then looked at Winston and then back down at his hand and asked, “What’s up with that?” Winston then withdrew his hand and she drove the rest of the trip in silence.
After the trip was over she sent her boyfriend a series of text messages indicating that “I just got semi molested by the Tampa Bay Bucs QB” and that she was “pretty shaken up . . .”
The next day, Kate contacted Uber to report what happened. She notified them in an email and subsequently provided a verbal statement in a recorded phone call with Uber’s Support Team. After considering the two statements and the ride documents, Uber concluded that Defendant Winston should be banned from their platform and notified him of that outcome.
Kate was not seeking financial compensation when she originally came public with her accusations in November 2017, but decided to sue after she perceived Winston’s response to the event showed a lack of remorse.
Previous to this incident, Winston was investigated for sexual assault while attending Florida State. Winston was never charged and the suit was settled out of court in 2016.

Winston is serving out a three-game suspension set by the NFL after an eight-month investigation concluded that Winston engaged in detrimental conduct that night by “touching the driver in an inappropriate and sexual manner without her consent and that disciplinary action was necessary and appropriate.”
The suspension is costing Winston $124,411 in game checks.
