Elissa Ennis, the girlfriend of former 49ers linebacker Reuben Foster, claims that the team interfered with a police investigation following the alleged domestic abuse she was a victim of.

Foster was cut after Ennis accused him of slapping her at the team’s hotel on Nov. 24 in Tampa. After she called the police, Ennis claims that the 49ers arrived to dissuade police from believing her story, informing them that she was the one who had previously lied about a similar situation. The 49ers denied any interference and released a statement on Thursday following Ennis’ testimony during a Good Morning America segment where she detailed the incident.

“The 49ers fully cooperated with authorities, assisted in locating Mr. Foster and in no way impeded their investigation,” a team spokesman said.

The 49ers placed Foster on waivers following the dispersion of the news. Nine’s general manager John Lynch said Foster was “not living up to what we had communicated and to the energy and the time that we’ve invested in him.” Foster was picked up by Washington, the only team to place a claim, just days after. Ennis called the pickup a “slap in the face.”

“I couldn’t believe someone picked him in up in how many hours?” Ennis said. “I was shocked.”

Foster is ineligible to play, as he is currently on the NFL commissioner’s exempt list, and is not expected to appeal his placement on the list as the legal process plays out.

On Tuesday, the Washington Redskins announced their decision to claim former San Francisco 49ers linebacker Reuben Foster off waivers.

Foster Picked Up By Redskins After Domestic Violence Incident

The announcement comes just two days after Foster was released by the 49ers following a weekend arrest on a domestic violence charge.

Foster was arrested at the team hotel in Tampa on Saturday night, and the 49ers released him the next day.

Tampa police said a 28-year-old female victim, later reported to be his girlfriend, had reported that Foster “slapped her phone out of her hand, pushed her in the chest area and slapped her with an open hand on the left side of her face.”

Later Tuesday, Foster was placed on the NFL commissioner’s exempt list pending a league investigation into the charge. Players on the list are not allowed to attend practices or play in games, which means it is highly unlikely that Foster will play for the Redskins this season.

Foster was booked into jail two hours after the arrest at the team’s Grand Hyatt in Tampa. His bond was set at $2,000 during a bail hearing Sunday morning, along with orders to avoid contact with the accuser, Foster’s girlfriend Elissa Ennis. Tampa Police reported finding a scratch on Ennis, as she accused Foster of pushing her, knocking a phone out of her hand and slapping her across the face.

Foster was previously arrested of domestic violence against Ennis in February but saw the allegation recanted, as Ennis said that she made the story up to damage Foster’s career. New 49ers general manager John Lynch and coach Kyle Shanahan stood by Foster following the previous charge, but assured this was Foster’s last chance. Lynch said that it was “extremely disappointing” to release Foster, who he moved up to pick in the 2017 draft.

“We have a set of standards in place that the players were involved with in developing,” Lynch said. “In this case, it was communicated exceptionally clear and to the point as to what we expected out of him, and unfortunately what transpired yesterday, this isn’t a comment on what happened there because that would be mere speculation on our part. It’s more of a comment on him not living up to what we had communicated and to the energy and the time that we’ve invested in him. That doesn’t mean we don’t love him — we all do, we care for him — but we feel like it’s in the best interest of our organization to move on at this point, and that’s a very tough decision.”

Although Lynch’s gamble on the previously red-flagged Foster didn’t work out, he says he doesn’t regret the move altogether. “I think we learn from it,” Lynch said. “You have to learn from every situation. Ultimately, these guys are human beings, and they’re young men, and they’re fallible. I think one thing we have to do, we have to learn from the process, and we have, and we will.”

Foster was also facing felony charges regarding an assault weapon, but those have been dropped down to a misdemeanor for which he will face a pre-trial hearing on June 6. However, Foster’s marijuana charge stemming from a January arrest is still in effect, and he will in court for that hearing on June 20.

The linebacker’s return to the 49ers is huge for the team from a football standpoint. Throughout his rookie season, Foster showed signs of being a great defender in the making, recording 59 tackles and 13 assists in 10 games, all of which he started. His play was good enough to earn him a spot on the NFL All-Rookie Team in 2017, and at 23-years-old, he’s slated to become the core of the 49ers defense in the coming years. And it’s a good thing too, considering the vast improvement of division rival Los Angeles Rams during this offseason, as well as the potential for Arizona Cardinals rookie quarterback Josh Rosen to be a huge threat in the NFC West for the next decade.

Ennis apparently fabricated the story because she wanted to destroy Foster’s bright career in the NFL and sue him after he broke up with her in February. She changed her story because she “had to do the right thing,” admitting that what she told authorities about Foster was untrue and that she stole money and a pair of Rolexes from him shortly following their breakup. Ennis told the court that she “was pissed and [she] wanted to end him,” before breaking down into tears. Following a short recess, she apologized to everyone involved, saying, “I’m sorry. I really am. I apologize to everybody.”

Ennis’s story was first set in motion on February 11, when she told authorities that Foster allegedly dragged her by the hair and hit her between 8 and 10 times, also claiming that he forcefully prevented her from reporting the crime. As a result, Foster has missed the entirety of the 49ers’ offseason so far as he awaited the development of his legal situation. This revelation changes everything, though, as what seemed like an almost definite suspension could actually turn into a whole lot of nothing.

While there hasn’t been any word from the 49ers organization since Ennis admitted to lying to authorities, Foster is set to appear in court on Wednesday, May 23 in order to see whether or not he will stand trial against the charges.

On February 11, police in Los Gatos, California responded to a distress call from a residence in the area. Officials soon revealed that Foster had assaulted his girlfriend and left her with a broken eardrum. The linebacker allegedly dragged the woman by her hair and subsequently punched her in the head eight to 10 times.

Foster’s arraignment was last week. He has ordered not to be in contact with the woman in any way. He is currently free on $75,000 bond. A plea hearing has been scheduled for April 30.

In addition to this issue, Foster has also been charged with second-degree marijuana possession in Tuscaloosa, Alabama following an arrest there on January 12. His hearing for that incident has been set for May 2.

The NFL could hand down severe punishment for either incident, including suspension.

In a statement issued last week, the league stated it would “continue to monitor all developments in this matter which is under review of the personal conduct policy.”

There has been some controversy in recent days over the fact that the league has thus far chosen to punish free agent Colin Kaepernick’s protests of the national anthem more than Foster for much more severe crimes. Last week, it was revealed the Seattle Seahawks postponed a workout with Kaepernick because he wouldn’t explicitly say he would stop kneeling for the anthem.

The 23-year-old San Francisco 49ers linebacker — a 2017 first-round pick out of Alabama — was arrested in Santa Clara County, California on Sunday after being charged with domestic violence, threats and possession of an assault weapon.

Police responded to a disturbance call made at approximately 9:15 a.m. at a Los Gatos residence. After speaking with Foster and the alleged victim, the linebacker was arrested and was held on $75,000 bail.

The Niners released a statement Sunday night saying they were still gathering information about the situation.

“The San Francisco 49ers organization is aware of the report regarding Reuben Foster,” the statement said. “We take matters of this nature seriously and are gathering all pertinent information.”

Foster was previously arrested in Tuscaloosa, Alabama on Jan. 12 for second-degree marijuana possession, a Class A misdemeanor in the state. He was released that night on $2,500 bond.

The linebackers’ arrests could lead to discipline from the NFL, up to and including a suspension. Foster’s cases both stand to be reviewed under the league’s policies on substance abuse and personal conduct.

Foster was second on the 49ers in tackles with 72 in 10 games.

Following Foster’s marijuana arrest, Niners general manager John Lynch said the linebacker needs to work on avoiding off-the-field problems.

The first-round pick’s arrest is the second related to domestic abuse since Lynch and head coach Kyle Shanahan joined the 49ers last year.

In April 2017, cornerback Tramaine Brock was arrested in Santa Clara on a felony domestic violence charge. The team released him the next day. The charges against Brock, now a Minnesota Vikings player, were dropped in August, and the league did not pursue any further discipline.

At that time, Lynch said the Niners’ handling of such issues would be carried out on a case-by-case basis.

The 49ers — who finished the 2017 regular season 6-10 — acquired quarterback Jimmy Garoppolo, a former New England Patriots backup, in a record-breaking five-year deal last week.
